These Terms of Service ("Terms") govern your access to and use of Mimelio, a landing page personalization platform operated by SWALA SAS. By creating an account or using the service, you agree to these Terms.
1. About Mimelio
Mimelio is a Software-as-a-Service product operated by SWALA SAS, a French société par actions simplifiée registered at 60 rue François Ier, 75008 Paris, France (Registered in France — SIREN 943 627 828).
Mimelio helps Google Ads advertisers analyze the structure of their campaigns, group keywords into intent segments, and personalize landing-page experiences for their visitors.
2. Eligibility & account
You must be at least 16 years old and have the legal capacity to enter into a binding agreement to use Mimelio. You agree to provide accurate registration information, to keep it up to date, and to keep your credentials confidential.
You are responsible for all activity that occurs under your account.
3. Your responsibility for connected Google Ads accounts
By connecting a Google Ads account to Mimelio you confirm that:
- You have the authority to grant Mimelio access to that Google Ads account.
- You will keep your Google Ads account in compliance with the Google Ads policies and applicable advertising laws.
- You are responsible for the content of campaigns, ads, keywords and landing pages you connect to or operate through Mimelio.
- You will not use Mimelio to violate any third-party rights, including intellectual-property and privacy rights.
4. Acceptable use
You agree not to use Mimelio to:
- Engage in illegal activity or activity that violates Google Ads or applicable advertising regulations.
- Send spam, mass unsolicited messaging, or scraped content.
- Reverse engineer the service or attempt to extract Mimelio's source code, except as expressly permitted by law.
- Interfere with or disrupt the integrity, security or performance of the service.
- Misrepresent your identity or impersonate any person or entity.
5. Intellectual property
Mimelio, including its software, design, brand and documentation, is and remains the exclusive property of SWALA SAS. We grant you a limited, non-exclusive, non-transferable right to use the service for your internal business purposes during your subscription.
You retain all rights to the data and content you connect or upload to Mimelio. By using the service, you grant us the limited rights necessary to operate the service for you (host, process, display).
6. Pricing & billing
Pricing is described on our pricing page. Subscriptions renew automatically unless cancelled before the end of the current billing period. Taxes are charged on top of the listed prices when applicable.
7. Service availability
We aim to keep Mimelio available and performant, but we do not guarantee uninterrupted access. We may schedule maintenance windows and will use reasonable efforts to notify users in advance. The service is provided "as is" and "as available".
8. Limitation of liability
To the maximum extent permitted by applicable law, SWALA SAS shall not be liable for indirect, incidental, special, consequential or punitive damages, or for any loss of revenue, profits or data, arising from or in connection with your use of Mimelio. Our total liability is capped at the amount paid by you for the service during the 12 months preceding the event giving rise to the claim.
9. Termination
You may terminate your subscription at any time from your account settings or by contacting support@mimelio.com.
We may suspend or terminate your access if you breach these Terms or if your usage materially harms the service, with reasonable prior notice except in cases of serious or repeated abuse.
Upon termination, your data is deleted as described in our Privacy Policy and Delete account page.
10. Changes to these Terms
We may update these Terms from time to time. Material changes will be notified by email or in the app at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.
11. Governing law
These Terms are governed by French law. Any dispute that cannot be resolved amicably will be submitted to the competent courts of Paris, France, subject to mandatory consumer-protection rules where applicable.
